Almost no civil case is settled by a jury. It is settled by the strength of the facts each side can prove, which makes the investigation behind a case as decisive as the argument in front of it.

The Vanishing Trial

The trial has all but disappeared.

In 1962, about one in eight federal civil cases was decided by a trial. Today it is fewer than one in two hundred. Trials have not become less important; they have become the rare exception, which means the real contest happens earlier, in what each side can establish through investigation and discovery. The firm that develops the better facts controls the terms of settlement.

Settlement Is the Norm

Even the cases built for trial rarely get one.

Personal injury matters are the kind people picture going before a jury, yet even they almost never do. In the most recent federal figures, motor vehicle injury cases reached trial 3.6% of the time and other injury cases 2.6%, against 0.4% for civil cases overall. When trial is that unlikely, leverage comes from the evidence in the file, the surveillance video, the located witness, the record no one else found.

Do you work directly with attorneys and their teams?

Yes. We work under counsel's direction as part of the litigation team, mindful of privilege and attorney work product, and we deliver findings in a form that fits straight into pleadings, discovery, and case strategy.

Can you accept a referral from a firm, or refer someone to an attorney?

Both. We partner with law firms as their investigators and take referrals for individual matters. When someone comes to us who needs legal representation first, we can connect them with reputable attorneys suited to the matter.
